Stepping in to assist the architects, we have obtained planning permission for an additional A3 restaurant at South Mimms Motorway Service Area on behalf of our clients, Welcome Break.
A planning application was made for an additional A3 unit to provide further restaurant space at the MSA. The architect was asked to withdraw the planning application by Hertsmere Council following receipt of a consultation response from the Council’s Parks Department who objected to the scheme on the grounds that the building would prevent access from the MSA to a regionally significant park, and prevent users of an adjacent bridleway using the MSA facilities.
We wrote to Hertsmere Council reminding them that the purpose of a Motorway Service Area are set out in DfT Circular 02/2013, The Strategic Road Network and the Delivery of Sustainable Development, and that while the development was in the Green Belt, the application should be determined under Paragraph 89 of the National Planning Policy Framework. The proposed development should be considered as an exception from the normal presumption against development in the Green Belt and that the building was not ‘inappropriate’.
The Council agreed, and subsequently issued planning permission for the scheme.
